A judge in Delaware has ordered Twitter to hand over more data to Elon Musk regarding how it calculates bot and fake accounts on the platform. However, the judge did not fully grant the billionaire’s “absurdly broad” requests for information on the organization’s entire user base in order to comply with the judge’s order.

Before the trial date of October 17 in the litigation over whether Musk must go through with his $44 billion takeover of the social media company, the lawyers representing the billionaire entrepreneur had requested additional data and documentation detailing the company’s determination of how many users were legitimate and could be served advertising. The trial will determine whether Musk must go through with his takeover.

Musk’s allegations that the firm misrepresented the number of bogus accounts on the network have been at the centre of his efforts to back out of his deal to purchase Twitter. Specifically, Musk has argued that the number of phoney accounts on Twitter was overstated. The acquisition was first agreed upon in April, before the slump of tech equities, which left Twitter’s market worth at just less than $32 billion.

During a hearing that took place on Wednesday, Twitter attorney Bradley Wilson said that the social network had been forthright in its disclosures on the fact that less than 5 percent of accounts were fraudulent or spam. He emphasised that the firm used “considerable judgement” in determining monetisable daily active users, or mDAUs, and he stated that the company’s “candid” disclosures provided it with legal protection against charges that it deceived investors.

On Thursday, the judge presiding over the case, Kathaleen McCormick, issued an order requiring Twitter to submit information involving 9,000 accounts that the company analysed for authenticity as part of an audit at the end of the previous year.

In addition to the mDAU metric, she ordered that Twitter must also release certain material pertaining to other internal debates or studies involving critical metrics concerning its user base. This material must concern the mDAU statistic.

However, the court agreed with Twitter’s position that it would be too difficult for the company to produce the complete range of data that Musk, who is the chief executive of Tesla, requested on its more than 200 million monthly active users (mDAU).

According to what the plaintiff had written, “[Musk’s] papers request would compel plaintiff to submit billions upon trillions of data points.” “[Twitter] is having trouble measuring the burden of responding to that request since no sane person has ever attempted to conduct an endeavour like that before,” said the spokesperson.

Alex Spiro, an attorney for Musk, stated that his client’s team was “excited to analyse the data Twitter has been suppressing for many months.”

Twitter does not wish to comment on the matter.

Musk’s efforts to demonstrate that the platform has been misrepresenting investors about the magnitude of the fake account problem on the social network might be aided by the data if it is found that the site has been doing so. He has asserted that the introduction of Twitter’s mDAU measure was a covert operation designed to wow Wall Street and offer cover for Twitter’s stalled growth and spiralling spam issue.

In the early part of this week, Peiter Zatko, who had previously served as the head of security for Twitter, made public a different whistleblower complaint that included assertions regarding active users that were comparable to those that had been reported to US authorities and members of Congress.

On September 13, Zatko, who was terminated from his position at the business in January, is scheduled to appear in front of the Senate Judiciary Committee. The appearance comes in the midst of requests for investigations into his assertions, which include charges that Twitter’s cyber security was insufficient and had been compromised by foreign forces. Among other things, he claimed that foreign countries had gained access to Twitter.

Musk released his own research of Twitter’s users earlier this month, in which he claimed that at least ten percent of Twitter’s users were phoney or bots, but the firm estimates that “less than five percent” of Twitter’s users are fraudulent or bots. In a second decision that was handed out on Thursday, the judge ordered the billionaire to make the research that supported that allegation available to the social media business.

According to documents that were made public on Wednesday, the number for the mDAU had also been the subject of investigation by the United States Securities and Exchange Commission. The markets regulator had written to Twitter in June requesting further clarification on the mDAU metric, as well as an explanation about how it had been incorrectly overinflated in 2019. A clarification was provided by Twitter early on in this year.

Twitter’s day-to-day operations are still being disrupted by the debate. During a meeting with all employees on Wednesday, officials disclosed that the percentage of employees leaving the company had increased to 18.1%. Chief Executive Officer Parag Agrawal responded to Zatko’s charges by calling them “inaccurate.” Reuters was the first news outlet to report on the discussion that took place during the staff meeting.
